Second national conference
a positive approach to implementing the
Mental Capacity Act in the Care of Older People
“The Mental Capacity Act 2005 stipulates that all adults are assumed to have capacity to make their own decisions unless it is proved otherwise. It introduces a lasting power of attorney whereby people can appoint someone to make decisions on their behalf‚ and has established Independent Mental Capacity Advocates (IMCAs) for support in specific circumstances‚ and a new Court of Protection. From April 2009‚ new provisions‚ known as Deprivation of Liberty Safeguards‚ (DOLS) have been introduced. These aim to protect people who lack capacity to consent from being moved to residential or hospital care in situations which amount to depriving them of their liberty.” Department of Health - www.dh.gov.uk, March 2009
The conference opens with a keynote introduction and national update from the Department of Health. This, the second national conference, provides an important opportunity for you to enhance your understanding of the Mental Capacity Act in the care of older people specifically focusing on legal issues including the new Deprivation of Liberty Safeguards, which came into effect April this year, best interests, advance decisions and lasting powers of attorney.
You will hear about The Independent Mental Capacity Advocates (IMCAs) for older people and improving the quality of the IMCA.service, and advanced care planning and supporting older people to make future decisions. Mervyn Eastman Co-Director and Company Secretary Change AGEnts and President The Practitioner Alliance Against Abuse of Vulnerable Adults (PAVA) will discuss the important topic of personalisation and safeguarding: challenges and tensions, including joining the agendas and the tension between regulation and guidance.
A special feature session provides you with an opportunity to learn from, question and debate with your peers and panel members about the Mental Capacity Act and its implementation in practice; Delegate led and interactive, the session is designed specifically to help answer your concerns and challenges and invites you, in advance of this conference, to submit your questions for discussion.
